A hallucinatory case was settled by a decision of the judges of the Bucharest Tribunal. A woman fought in court to prove that a lawyer had sold and collected money in her name on a land she had not been living for years. Behind the illegal business is Dumitru Niţurad, an excluded lawyer from the Bucharest Bar, in 2012. He defended the famous "Guru" Gregorian Bivolaru years ago and pleaded against Klaus Iohannis in a trial of retrocession.
He became famous after defending Gregorian Bivolaru in 2004, and tried to convict Klaus Iohannis, in 2006, former lawyer Dumitru Niţurad took up suspicious business with land. From our information, his law firm concluded several bilateral sales and purchase promises for land in Bran, Moeciu, Braşov County, but also from Rucăr or Dragoslavele, Arges County, although he had been excluded from the law. Through such a scam, Niţurad tried to sell a ghost land from Argeş County.
In debt without knowing
The case came to light after a woman in Bucharest woke up in front of a judge who was asked to pay 100,000 lei for a business he did not know about. Thus, it was found that Dumitru Niţurad tried to sell, by forgery, a plot of land from Dragoslavele commune, Argeş county. The land belonged to the woman but was alienated as early as 2007. As it appears from the documents in the case filed at the Bucharest Tribunal, the victim asked for the false registration and the absolute nullity of the fraudulent acts concluded at the Individual Law Cabinet "Niturad Dumitru" . Former lawyer concluded in 2011 on the basis of a fiduciary contract, through which his law firm was empowered to represent a company, a bilateral promise of sale-purchase of the land in Dragoslavele with Transeuropa Construct SRL, has in the meantime changed its name to Transeuropa Commodities SRL. The company was controlled by Eugenia Radu, but in the act concluded by Niţurad appears as a representative of the company Nicolae Frâncu, who had no quality within the company, registered with the Trade Register. Virtually Dumitru Niţurad falsified the signature of Nicolae Frâncu and the victim.

He falsified her signature
It is certain that Niţurad has made two bilateral sale-purchase promises as a representative of the woman who falsified her signature, on the basis of which SC Transeuropa Commodities SRL transferred the lawyer to her account on 2 and 4 February 2011, the amount of 1.4 million lei. The money was the advance for the land of Dragoslavele. In September 2011, the deal would have fallen. Attorney Niţurad submitted to the court a plea in which he claimed that Eugenia Radu had financial problems and therefore could not have paid off the money and gave up the deal. During the process, he was asked for his original documents: sale and purchase promises and resolutions, that is, acts that would have terminated the cartels. He brought four "according to the original" documents, stamped by "Niţurad's lawyer". The culmination is that these papers have been accepted by the court, although it is clear that, next to the name of the woman, one of the promises is written in both blue and black and one page of the document is not signed, as it should . At the request of the woman's lawyer, Elena Ramona Iorga, and the liquidator appointed in court, the court ordered sending the papers presented as original documents to the National Forensic Institute, in order to verify the authenticity of the signatures. The answer showed that the documents considered by the court to be original are in fact color copies, which can not be subjected to graphological expertise and can not produce legal effects. In conclusion, the victim has no procedural merit, since he has not signed any bilateral promises in relation to that land, has not signed any resolutions on the bilateral sale-purchase promise.
From the falsified documents it appeared that the owner of the land would have withheld the amount of 100,000 lei, as a sanction, for not concluding the contract in authentic form. At the same time, the bankruptcy firm demanded the recovery of 1.4 million lei. The trial also revealed that the area of 24,000 square meters had been valued by Niţurad at 89-90 euros / sq. M, although the real value in the area was under one square meter. Finally, the court ruled that the former lawyer had to return the company's money and canceled Ntudurad's acts on behalf of the woman.
Former prosecutor who escaped the MISA leader
In his defense, Dumitru Niţurad told the court that the money received in advance would have given him the land. He did not, however, present any evidence to prove this. We tried to contact him, but no phone number posted on the internet at his office was no longer valid.
Dumitru Niţurad was a prosecutor at the Ialomiţa Prosecutor's Office until 1991. He then became a lawyer. In 2012, he was expelled from the Bucharest Bar. He defended "Guru" Gregorian Bivolaru from March to August 2004 and managed to escape his imprisonment after being accused of abusing a teenage yoga practitioner. Shortly afterwards, the founder of the Absolute Integration Spiritual Movement (MISA) has called for political asylum in Sweden, where it is still present, although it is being pursued internationally via Interpol.
The process that led to Klaus Iohannis' research
Also in 2006, Dumitru Niţurad defended Vasile Teusan, a Sibiu who sued the mayor, since then, Klaus Iohannis. That process led to the investigation of the current President of Romania for abuse of office, for the restitution of a building that was already bought by Teusan from the state. Following this case, Klaus Iohannis was also investigated by the DNA.
